This Privacy Policy explains how Worqforce LLC, a New York limited liability company ("Worqforce LLC," "Worqforce," "we," "us," or "our"), collects, uses, discloses, retains, and otherwise processes personal information when you access or use the Worqforce platform, website, applications, and related services (collectively, the "Service").
This Privacy Policy is intended to function as a general notice of our information practices. Where applicable law requires consent for a specific activity, we will request that consent separately. By using the Service, you acknowledge this Privacy Policy.
The Service is intended for users in the United States and for individuals who are at least eighteen (18) years old.

This may include your name, email address, password, phone number, mailing address, current and prior job titles, employers, years of experience, work history, education, certifications, skills, portfolio or LinkedIn links, professional summary, job preferences, salary preferences, work arrangement preferences, uploaded resumes and cover letters, outreach drafts, application answers, and support communications.
1.2 Account and Subscription Information. We collect subscription-plan selections, billing history, payment status, invoices, receipts, and related account-administration records. Payment-card details are generally processed by our payment processor rather than stored by us in full.
1.3 Sensitive or Optional Information. Depending on how you use the Service, you may choose to provide or direct us to process information that may be considered sensitive under applicable law, such as work-authorization status, visa-sponsorship needs, Equal Employment Opportunity (EEO) or demographic information, disability or veteran status, racial or ethnic information, gender identity, sexual-orientation information, or similar application-related disclosures. Unless expressly stated otherwise, providing this information is voluntary, and we use it only for the limited purposes described at the point of collection, in this Privacy Policy, or in your settings and instructions.
1.4 Automatically Collected Information. We may automatically collect device, browser, and usage data such as IP address, browser type, operating system, device identifiers, pages viewed, clicks, feature usage counts, timestamps, referring URLs, error logs, crash data, and records concerning applications, messages, and workflow events.
1.5 Information from Third Parties and Integrations. If you connect or authenticate through a third-party service, such as Google, or if you import information from a resume, profile, or other external source, we may receive the information you authorize that third party to share with us.
1.6 Information Submitted to Employers and Platforms. When you use the Service to prepare, transmit, or track an application or communication, we may collect and store the related job title, company name, application status, timestamps, platform used, message content, and related metadata.
1.7 Do Not Upload Unnecessary High-Risk Data. Unless the Service specifically requests it for a defined purpose, please do not upload Social Security numbers, driver's-license numbers, passport numbers, financial-account numbers, tax records, medical records, or other highly sensitive identifiers.
2.1 Service Delivery. We use personal information to create and manage accounts, authenticate users, provide the Service, generate or refine materials, recommend opportunities, identify contacts, track applications, transmit user-directed applications or communications, and provide support.
2.2 Subscription Administration. We use information to process payments, provide receipts and billing notices, manage subscriptions, enforce usage limits, detect abuse, and administer plan entitlements.
2.3 Service Improvement and Operations. We use information to maintain, troubleshoot, secure, monitor, test, analyze, and improve the Service; develop new features; train personnel; and understand aggregate product usage.
2.4 Communications. We use your contact information to send transactional, administrative, security, and subscription-related messages. With your consent where required, we may also send product updates, job alerts, feature announcements, or other marketing communications, and you may opt out of non-essential marketing communications at any time.
2.5 Security, Fraud Prevention, and Legal Compliance. We use information to detect, investigate, and prevent fraud, abuse, unauthorized access, and other harmful activity; to enforce our Terms; to protect rights, safety, and property; and to comply with law, legal process, governmental requests, and recordkeeping obligations.
2.6 Limited Use of Sensitive Information. We use sensitive personal information only as reasonably necessary to provide the feature or service you requested, to complete an application or disclosure you directed us to complete, for security and fraud prevention, for legal compliance, or for other purposes permitted by applicable law and disclosed to you.
3.1 Service Providers and Processors. We disclose personal information to vendors and service providers that perform services on our behalf, such as hosting, authentication, security, analytics, customer support, email delivery, AI processing, cloud infrastructure, and payment processing.
3.2 Employers, Recruiters, Job Boards, and Other Recipients You Select. When you direct us to apply to a job, save or transmit application materials, send outreach, or otherwise interact with a third party, we disclose the information necessary to complete that action. Once information is submitted to a third party, that third party's terms and privacy practices apply.
3.3 Corporate Transactions. We may disclose information in connection with an actual or proposed financing, merger, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, subject to customary confidentiality and legal constraints.
3.4 Legal and Protection Disclosures. We may disclose information when we believe doing so is reasonably necessary to comply with law, legal process, or enforceable governmental requests; to enforce our agreements; to protect the rights, safety, or property of Worqforce, users, or others; or to detect and prevent fraud or security issues.
3.5 Disclosures with Consent or at Your Direction. We may disclose information for other purposes with your consent or at your specific direction.
3.6 Sale or Sharing. We do not sell personal information for money. We may disclose identifiers, internet or network activity, and similar information to processors, service providers, analytics providers, and other vendors acting on our behalf. If our practices are ever deemed a "sale," "sharing," or targeted-advertising disclosure under applicable law, we will offer the rights and controls required by law.
4.1 AI Processing. To provide AI-assisted features, we may send relevant portions of your prompts, profile, documents, preferences, and related metadata to third-party AI providers for processing.
4.2 Data Minimization. We seek to send only the information reasonably necessary for the requested feature or workflow.
4.3 Vendor Restrictions. Where supported by our provider contracts and account configurations, we instruct service providers that process customer data for us to use that data only to provide services to us, subject to limited retention, logging, abuse monitoring, security, or legal-compliance rights described in their contracts and policies.
4.4 No Employer Decision-Making by Us. We use AI to assist users with drafting, matching, ranking, and workflow automation. Worqforce does not make hiring decisions for employers, and employers remain solely responsible for employment decisions.
5.1 Essential Technologies. We use cookies, local storage, session storage, and similar technologies to authenticate users, maintain sessions, remember settings, protect the Service, and support core functionality.
5.2 Analytics and Measurement. We may use analytics tools to understand usage, diagnose issues, improve the Service, and measure feature performance. Where practical, we use aggregated, de-identified, or otherwise minimized data.
5.3 Choices. Depending on the tool and applicable law, you may be able to control cookies through your browser settings, device settings, or any cookie controls we make available. Disabling certain technologies may affect functionality.
5.4 Advertising Technologies. If we use advertising or cross-context behavioral tracking technologies in the future, we will provide any notices, consent requests, or opt-out mechanisms required by law.
6.1 Security Program. We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, destruction, use, modification, or disclosure. Our safeguards may include access controls, encryption in transit where appropriate, logging and monitoring, vendor diligence, workforce training, incident-response procedures, testing, and secure disposal practices.
6.2 No Absolute Security. No security measure is perfect or impenetrable. We cannot guarantee absolute security, and you should use strong passwords, protect your credentials, and notify us promptly of suspected unauthorized access.
6.3 Incident Response. If we determine that a security incident requires notice under applicable law, we will provide notice in accordance with our legal obligations.
7.1 General Retention Approach. We retain personal information for as long as reasonably necessary to provide the Service, maintain your account, fulfill the purposes described in this Privacy Policy, enforce our agreements, resolve disputes, comply with law, prevent fraud, and protect our legal interests.
7.2 Account Data. We generally retain account and profile information for as long as your account remains active.
7.3 Deletion Requests and Account Closure. If you delete your account or make a valid deletion request, we will delete or de-identify personal information from active systems within a commercially reasonable period, generally within thirty (30) days, unless retention is required or permitted by law, necessary for security, dispute resolution, fraud prevention, tax or accounting records, or necessary to complete transactions you requested.
7.4 Backups and Logs. Backup copies and system logs may persist for a limited period after deletion from active systems, generally up to ninety (90) days, after which they are overwritten or deleted in the ordinary course.
7.5 De-Identified and Aggregate Data. We may retain de-identified, anonymized, or aggregated information for longer periods where permitted by law.
8.1 Account Access and Corrections. You may access, review, and update certain information through your account settings.
8.2 Marketing Opt-Out. You may opt out of non-essential marketing emails by using the unsubscribe link in the message or by contacting us. You may still receive transactional or service-related communications.
8.3 Auto-Apply and Outreach Controls. You may disable Auto-Apply or change outreach settings through the Service. Changes may not affect submissions already transmitted or workflows already in progress.
8.4 Consent Withdrawal. Where we rely on consent, you may withdraw it at any time for future processing. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal.
8.5 Privacy Requests. We may need to verify your identity before honoring a request.
8.6 Limits and Exceptions. Your rights may be limited by applicable law. For example, we may deny or limit a request if we cannot verify your identity, if an exception applies, or if retaining the information is necessary for legal, security, or operational reasons.
9.1 State Law Rights. Depending on where you live and the applicability of state privacy law, you may have some or all of the following rights: to know or access, delete, correct, obtain a portable copy, opt out of sale, sharing, or targeted advertising, limit the use or disclosure of sensitive personal information, appeal certain denials, and be free from unlawful discrimination for exercising privacy rights.
9.2 California Residents. If the California Consumer Privacy Act (CCPA), as amended, applies, California residents may have the rights to know, delete, correct, opt out of sale or sharing, limit the use and disclosure of sensitive personal information, and receive equal service and price even if they exercise their rights, subject to statutory exceptions. We will process verified requests in accordance with applicable law.
9.3 Authorized Agents and Verification. Where permitted by law, you may designate an authorized agent to make a request on your behalf. We may require proof of authorization and identity verification for you and/or your agent.
9.4 Appeals. If applicable law gives you a right to appeal our denial of a privacy request, we will tell you how to submit an appeal in our response.
9.5 Retention of Rights Data. We may keep records of privacy requests and our responses for compliance, audit, and recordkeeping purposes.
10.1 Not Directed to Children. The Service is not directed to children under eighteen (18), and we do not knowingly collect personal information from children.
10.2 If We Learn of Collection from a Child. If we learn that we have collected personal information from a child in violation of applicable law, we will take steps to delete it.
11.1 U.S.-Based Service. The Service is based in the United States and is primarily intended for U.S.-based use.
11.2 Transfers. If you access the Service from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States and other jurisdictions where we or our service providers operate, which may have data-protection laws different from those in your home jurisdiction.
11.3 Availability Limitations. We may limit the availability of the Service in certain jurisdictions for legal or operational reasons.
12.1 External Sites. The Service may link to or interact with third-party websites, job boards, or employer systems. We are not responsible for the privacy practices or content of those third parties.
12.2 Review Their Policies. We encourage you to review the privacy policies and terms of any third-party sites or services you use.
13.1 Updates. We may revise this Privacy Policy from time to time.
13.2 Notice of Material Changes. If we make a material change, we will update the effective date and provide notice in the manner required by law. If a materially new use of personal information requires consent, we will seek that consent where required rather than relying solely on continued use of the Service.
13.3 Prior Versions. Earlier versions of this Privacy Policy may remain available on request or as otherwise required by law.
